Car Insurance

Postby NowayJose » Wed Aug 24, 2011 8:49 am

A quick question that I have and am getting conflicting information about : My family has 2 cars, 1 of which is going to be off the road for the unforeseeable future (in my garage) and as such I have tried to cancel my insurance policy. My broker has told me that legally all cars in Spain must have Insurance all of the time, whether they are taken off the road or not. This doesn't seem quiet right to me - can anyone confirm the situation for me either way ?

I have never heard of any such law or requirement before. Maybe they are just seeing how far they can push you into getting a renewal from you ?

Just ask them to direct you to the relevant page on the DGT website that confirms that what they are saying is legal and correct. Ten Euros says that they will never come back to you. Simples.

I can't say that I know the answer to this question either way, but my first impression is that the broker is simply trying it on with you, knowing that 6 out of every 10 Guiris would fall for this line ...

Thankyou, that pretty much confirms my thoughts, but I just wanted a second opinion.

There is a royal decree to this effect stating that there is an obligation to keep your vehicle insured at all times. The only exception would be if the vehicle has had a baja.

This is the decree information - "Real Decreto Legislativo 8/2004, de 29 de octubre, por el que se aprueba el texto refundido de la Ley sobre responsabilidad civil y seguro en la circulación de vehículos a motor."

That's a very good point you make MJW31A ( and NowayJose ). As such we have taken a look into the finer details of the Royal Decree and the legal requirement here to write a simplified guide on this very issue if you would care to take a look ....

It may well be a "Royal Decree" but I wonder how many people are either unaware of this and have a vehicle off-road without insurance OR know about it and try and get away with it ?

Equally so, I wonder how many times the authorities know about this, but simply can't be bothered to do anything about it ?

I accept that ignorance is defence of the law, but I brought an old classic car over from the UK to work on and didn't have it insured while it was locked in my garage and being worked on. Nobody found out or did anything about it. I can't see how anyone could find out ?
