There will be two exceptions written into the new anti-smoking legislation in Spain to be introduced later this year. These have been included for what is referred to as ‘humanitarian reasons’, with the notable exception of two places – prison and on the psychiatrist’s couch.
These two exceptions were already noted in the previous Ley28/2005 legislation, but it’s understood that they will be carried forward into the new law.
‘Prohibiting tobacco, coffee or soft drinks in any jail in the country would be a time bomb which could explode at any moment’, prison union ACAIP told 20mintos.es, also stating how there are no official smoking areas in prison.
The draft of the new legislation will be presented by the Minister for Health on June 22nd. It is believed that the finer details are still being finalised, but what is known is that it will bring an end to all smoking in enclosed public places, which ends the current permission for small bars and smoking areas in larger ones.
