Sean Connery, ordered to testify today at a Marbella court, has written to the judge stating how he and his wife would be unable to attend due to health reasons.
The letter went on to say how, due to their "age and state of health" they would be unable to travel to the Marbella court from their home in the Bahamas. The judge would now be deciding whether to send court officials to question the couple at their home, the source said.
The actor was first named back in May in the investigation dubbed "Goldfinger" after the 1964 James Bond film and which involves the sale of his luxury seaside villa near the popular and exclusive resort of Marbella.
The villa was sold in 1999 reportedly for around nine million dollars (6.5 million euros). It was soon demolished, and a four-storey luxury apartment complex with 72 flats was constructed on the plot where it once stood - despite planning rules which said only five homes could be built.
In May police raided the Madrid and Marbella offices of a law firm which is believed to have handled the sale of the firm.
The couple have not been arrested and are not facing any charges in the case.
