Spain Telecomms providers see decline in text messages

Spain's Telecommunications Market Commission (TMC) has reported that since 2009, when the Code of Conduct was brought into effect for premium service charges (Servicios de Tarificación adicional), there has been a significant drop in useage and overall revenue obtained from SMS text messages.

The Code of Conduct requires the provides of premium services, such as SMS messages, to comply with a number of practices intended to protect the rights of consumers. Examples of some of these practices include: obtaining the customer's consent to be able to charge for the service (except premium SMS services when the price is less than €1.20 and no subscribed); providing clear information on how to subscribe or opt out of the service; and offering a standard of better customer service.

The Code also states that providers must warn consumers when their account has reached an agreed limit, but does not make any provision for what this maximum limit should be.

Users who subscribe to SMS services on where the cost is greater than €1.20 will see the maximum number of SMS sent per service limited to just the one message. Previously some providers had split the subscribed service into multiple SMS messages and charged for the service accordingly.
