The High Court of Spain has upheld a decision which imposed a €60,000 penalty awarded by the Spanish Data Protection Authority (SDPA) against a shopping centre for recording images of people passing by with CCTV cameras installed on the outside of the building.
Court proceedings were initiated following a complaint by one individual against the shopping centre in question with the SDPA. As a result of the complaint, the SDPA conducted a thorough on-site investigation which concluded that the shopping centre illegally captured images of passers-by with the cameras that they had mounted externally.
Spanish law states that the ability to install CCTV cameras that are capable of recording such data on passersby is restricted exclusively to the state security forces.
