For the first time since the M15 'Los Indignados' group changed focus from street protests to preventing the eviction of residents from repossessed homes, the Madrid police were called yesterday to aid the court process.
Over 50 anti-riot police sectioned off a small neighbourhood in the capital to prevent demonstrators from blockading the property in question.
The bailiff had previously attempted to serve an eviction notice on the unemployed single mother, who has a disabled son, but this time the protest group were unable to prevent the family from being forced to leave their home.
The action group, who is now calling itself the 'Platform for the Mortgage Affected' (PAH), has been able to prevent 50 court evictions for non-payment of mortgages, took action yesterday morning when it found out the court had issued a second notice for the family, following their prevention of the first notice on July 6th.
The Police were able to keep the group away from the property to allow a number of court and police officials, together with a locksmith to gain entry.
Rafael Mayoral, who is the PAH legal advisor, was not permitted to enter the property after earlier filing a complaint against issuing Judge María Trinidad Cepa, for disregarding her judicial duty by not "alerting the neighbors about the eviction so that they could argue against it," which is a requirement under the Law of Civil Trial Procedure.
Both the mother and the 25 year old daughter are unemployed and act as carers for the son, who is 77% disabled. The family income totals some 687 per month due benefit payments on behalf of the son. Rising debts forced the family to re-mortgage their home some years ago with Caja de Ahorros del Mediterráneo (CAM), who are now demanding 200,000 euros plus interest.
PAH has demanded that the local council find her a home.
