The European Court of Justice has upheld an appeal by the Spanish Government to gain recognition of a nature site which falls within Gibraltar territorial waters.
This is the 2nd time such an appeal has been lodged by Britain in an attempt to overturn the ruling.
Whilst this 'recognition' does not give Spain any jurisdiction or authority in these waters, nor does it suggest any lessening of either countries stance on sovereignty of the rock, it is being claimed as a truimph by the Spanish, and has left the British claiming to be "considering their next move".
The crux of the appeal centered around whether the European Commission should have known that the Spanish site overlapped with an existing British one, and what steps it should have taken to consult Britain before approving it.
The British Government said that, irrespective of the ruling, it will not recognise Spain's listed site in Gibraltar waters.
